Welcome to Brandmoshai. These Terms and Conditions ("Terms") govern your use of our website and services. By engaging our services or accessing our website, you agree to be bound by these Terms.
1. Services
Brandmoshai provides digital agency services including web development, mobile app development, UI/UX design, brand identity design, digital advertising, and growth strategy consulting. The specific scope, deliverables, and timelines for each project will be outlined in a separate proposal or statement of work (SOW).
2. Engagement & Proposals
All projects begin with a detailed proposal outlining scope, timeline, and pricing. A project is considered active once the client provides written approval (including email) and any required upfront payment has been received. Changes to the original scope may result in adjustments to timeline and cost.
3. Payment Terms
- A non-refundable deposit of 30–50% is required before work begins.
- Remaining payments are due at agreed-upon milestones or upon project completion.
- Invoices are payable within 7 business days unless otherwise agreed.
- Late payments may incur a 2% monthly late fee on outstanding balances.
- All fees are quoted in BDT or USD unless otherwise specified.
4. Intellectual Property
Upon full payment, the client receives ownership of all custom deliverables, including source code, design files, and related assets. Third-party assets remain subject to their respective licenses. Brandmoshai retains the right to showcase completed work in our portfolio unless a non-disclosure agreement is in place.
5. Client Responsibilities
- Providing content, assets, and brand materials in a timely manner.
- Providing feedback and approvals within agreed review windows.
- Ensuring content provided does not infringe third-party rights.
- Maintaining backups before migration or updates.
6. Revisions & Scope Changes
Each project includes two to three revision rounds per deliverable. Additional revisions are billed at our standard hourly rate. Major scope changes require a revised proposal and written approval.
7. Limitation of Liability
Brandmoshai's total liability for any claim shall not exceed the total fees paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate with 14 days' written notice. The client is responsible for payment of all work completed. The initial deposit is non-refundable. Completed deliverables will be transferred upon settling all outstanding payments.
9. Governing Law
These Terms are governed by the laws of Bangladesh. Disputes shall be resolved through negotiation, and if necessary, the courts of Dhaka, Bangladesh.
